Brandon Heanue Faces Judge, Charged for Deaths of Matchus Brothers

Cass County, NE - A Cass County man is in court, facing charges for the deaths of two friends. Brothers Kyle and Michael Matchus were killed in a June rollover crash near South Bend. The county attorney filed motor vehicle homicide charges against Brandon Heanue, saying his vehicle caused the Matchus vehicle to lose control. But his attorney says prosecutors can't even pin down what Heanue did.

Bill Gallup:  "The complaint alleges that he caused the death of these two young men either by speeding, drag racing, by passing in a no passing zone or by careless driving. In other words, they don't tell me what he did that was wrong."

According to a Cass County Sheriff's report, some witnesses say Heanue was racing the car the Matchus brothers were in, passed in a no passing zone, merged back too soon, and forced the Matchus vehicle off the road.

Nathan Cox: "After having reviewed these facts it seemed appropriate to file these two counts that I did."

County Attorney Nathan Cox believes the charges hold Heanue accountable for his actions. As for Heanue himself, his lawyer claims he's getting support from the Matchus family.

Bill Gallup: "The father of the two victims was here saying anything he can do to help he wants to. I think things will probably work out okay."

Brandon Heanue will be back in court on January 6th for a pre-trial conference.
